PlateProfile Labs LLC (“PlateProfile,” “Company,” “we,” “our,” or “us”) respects your privacy and is committed to protecting your Personal Information. This Privacy Policy explains how PlateProfile collects, uses, stores, processes, protects, discloses, retains, and otherwise handles information obtained through your use of the PlateProfile mobile application, websites, web-based services, APIs, artificial intelligence systems, recommendation engine, subscription services, customer support services, and all related products, features, and functionality (collectively, the “Services”).
This Privacy Policy applies to both current Services and future PlateProfile products, features, and functionality that reference or incorporate this Privacy Policy unless a separate privacy policy is provided.
This Privacy Policy applies whenever you:
● download or use the PlateProfile mobile application;
● create or access an Account;
● visit a PlateProfile website;
● subscribe to PlateProfile Plus or other subscription services;
● interact with our AI Recommendation Engine;
● use Restaurant Mode, Pantry Features, grocery features, or related functionality;
● contact customer support;
● participate in surveys, promotions, or beta programs; or
● otherwise use any portion of the Services.
By accessing or using the Services, you acknowledge that you have read and understand this Privacy Policy.
This Privacy Policy should be read together with our Terms of Service, which govern your use of the Services. In the event of any conflict between this Privacy Policy and the Terms of Service regarding privacy practices, this Privacy Policy shall govern those privacy matters to the extent required by applicable law.
This Privacy Policy applies to information collected through all PlateProfile Services, including, without limitation:
● the PlateProfile mobile application;
● PlateProfile websites;
● web-based administrative portals;
● APIs and software integrations;
● the AI Recommendation Engine;
● Restaurant Mode;
● Pantry Features;
● grocery list functionality;
● meal recommendations;
● nutritional recommendation features;
● subscription services;
● customer support communications;
● future PlateProfile products and services; and
● any other online services operated by PlateProfile that reference this Privacy Policy.
This Privacy Policy applies regardless of the device, platform, operating system, or method used to access the Services.
Certain Third-Party Services integrated with PlateProfile may maintain their own privacy policies. This Privacy Policy applies only to PlateProfile’s collection and processing of information and does not govern the privacy practices of independent third parties except as otherwise required by applicable law.
For purposes of this Privacy Policy, the following definitions apply:
Account means a registered PlateProfile user account.
AI Output means any recommendation, meal suggestion, restaurant recommendation, grocery recommendation, ingredient substitution, nutritional information, ranking, explanation, score, prediction, generated content, or other output produced, assisted, or influenced by PlateProfile’s artificial intelligence systems.
AI Recommendation Engine means PlateProfile’s proprietary collection of software, algorithms, Bayesian methodologies, statistical models, machine learning systems, personalization logic, optimization techniques, recommendation methodologies, and related technologies used to generate and improve recommendations.
Consumer Health Data means information that identifies an individual’s past, present, or future physical or mental health status, or information reasonably linkable to such health information, as defined by applicable law, including the Washington My Health My Data Act where applicable.
Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an identified or identifiable individual, as defined under applicable privacy laws.
Sensitive Personal Information means Personal Information that receives additional legal protections under applicable law, including certain health-related information, precise geolocation data, account credentials, and other protected categories recognized by applicable privacy laws.
Services means the PlateProfile mobile application, websites, APIs, AI Recommendation Engine, subscription services, content, software, and all related products and functionality offered by PlateProfile. Subscription Services means PlateProfile Plus and any paid subscription products or premium functionality offered by PlateProfile.
Third-Party Services means independent software providers, cloud hosting providers, payment processors, grocery providers, restaurant information providers, authentication providers, mapping providers, analytics providers, artificial intelligence providers, wearable integrations, notification providers, and other external services that support or integrate with PlateProfile.
User Content means information submitted by users, including dietary preferences, allergies, intolerances, food dislikes, favorite foods, nutrition goals, pantry information, grocery information, meal history, saved meals, restaurant selections, profile information, photographs, comments, ratings, reviews, and other information voluntarily submitted through the Services.
The information we collect depends upon how you interact with the Services, the permissions you grant, your device settings, and the features you choose to use.
PlateProfile collects only the information reasonably necessary to provide, maintain, secure, improve, personalize, and support the Services consistent with this Privacy Policy and applicable law.
Information You Provide
You may voluntarily provide information including:

● email address;
● account credentials;
● profile information;
● dietary preferences;
● food allergies;
● food intolerances;
● food dislikes;
● favorite foods;
● nutrition goals;
● meal preferences;
● pantry information;
● grocery information;

● meal history;
● customer support communications;
● survey responses;
● feedback;
● photographs or images you choose to upload; and
● any other information you voluntarily provide.
Providing certain information may be necessary for the Services to function as intended. You are responsible for ensuring that information you provide is accurate and current.
Information Collected Automatically
When you use the Services, PlateProfile may automatically collect certain technical information, including:
● device type;
● operating system;
● application version;
● device identifiers;
● IP address;
● language settings;
● time zone;
● crash reports;
● diagnostic information;
● usage analytics;
● interaction data;
● log files;
● performance information;
● authentication events;
● subscription status;
● approximate location derived from technical information; and
● other technical information reasonably necessary to operate, secure, and improve the Services.
Location Information
With your permission, PlateProfile may collect precise location information to support features such as Restaurant Mode, nearby dining recommendations, and location-based functionality. If you do not grant location permission, certain location-dependent features may be unavailable or operate with reduced functionality.
You may enable or disable location permissions through your device settings at any time. Certain personalized recommendations, including Restaurant Mode and nearby dining suggestions, may be unavailable or less accurate if location permissions are disabled.
Certain information collected through the Services—including dietary preferences, food allergies, food intolerances, nutrition goals, meal selections, food history, ingredient preferences, and similar information—may constitute Consumer Health Data under applicable law, including the Washington My Health My Data Act.
PlateProfile collects Consumer Health Data only to the extent reasonably necessary to provide, personalize, maintain, secure, and improve the Services.
Consumer Health Data may be used for purposes including:
● generating personalized meal recommendations;
● providing Restaurant Mode recommendations;
● creating grocery recommendations;
● maintaining Pantry Features;
● improving recommendation accuracy;
● personalizing future recommendations;
● maintaining your Account;
● responding to customer support requests;
● protecting users and the Services from fraud or abuse;
● complying with legal obligations; and
● other purposes described in this Privacy Policy or otherwise authorized by applicable law.
PlateProfile does not sell Consumer Health Data except as expressly disclosed in this Privacy Policy or where permitted by applicable law. Additional information regarding the collection, use, disclosure, retention, deletion, and protection of Consumer Health Data, including rights available to Washington residents, is provided later in this Privacy Policy.
Certain information collected through the Services may constitute Sensitive Personal Information or similarly protected information under applicable law. Depending upon the features you use and the information you choose to provide, this may include:
● dietary restrictions;
● food allergies;
● food intolerances;
● nutrition goals;
● Consumer Health Data;
● precise location information (when authorized by you);
● account authentication credentials; and
● other information afforded heightened protection under applicable law.
PlateProfile collects and processes Sensitive Personal Information only for legitimate business purposes, including:
● providing personalized recommendations;
● operating and maintaining the Services;
● improving the AI Recommendation Engine;
● protecting users and the Services;
● preventing fraud, abuse, and unauthorized access;
● complying with legal obligations; and
● other purposes described in this Privacy Policy or authorized by applicable law.
Where required by applicable law, PlateProfile provides users with the ability to exercise applicable rights regarding Sensitive Personal Information. PlateProfile does not use Sensitive Personal Information for purposes that are materially different, unrelated, or incompatible with the purposes disclosed in this Privacy Policy without providing any notices or obtaining any consent required by applicable law.
PlateProfile uses the information we collect to operate, improve, personalize, secure, and support the Services.
Depending upon the circumstances, we may use your information to:
● create personalized meal recommendations;
● generate grocery recommendations;
● generate restaurant recommendations;
● provide Pantry Features;
● personalize AI-generated recommendations;
● improve recommendation quality;
● remember user preferences;
● adapt recommendations over time;
● provide customer support;
● maintain your Account;
● authenticate users;
● process subscription purchases;
● communicate with users;
● improve accessibility;
● monitor application performance;
● identify and correct software defects;
● conduct analytics;
● perform research and product development;
● protect against fraud, abuse, unauthorized access, and other security risks;
● comply with legal obligations;
● enforce our Terms of Service; and
● develop future PlateProfile products, features, and functionality.
The accuracy and quality of personalized recommendations depend, in part, upon the accuracy, completeness, and currency of the information provided by the user.
PlateProfile may also use aggregated, anonymized, or de-identified information for analytics, statistical reporting, product development, research, security, and business operations to the extent permitted by applicable law.
Where required by law, PlateProfile will obtain appropriate consent before using Personal Information for purposes requiring such consent.
PlateProfile’s AI Recommendation Engine is designed to personalize meal, grocery, pantry, and restaurant recommendations based upon information available at the time recommendations are generated.
Depending upon available information, recommendations may consider factors including:
● dietary preferences;
● food allergies;
● food intolerances;
● nutrition goals;
● favorite foods;
● food dislikes;
● meal history;
● accepted recommendations;
● rejected recommendations;
● saved meals;
● ingredient substitutions;
● grocery history;
● pantry information;
● restaurant selections;
● prior interactions with the Services;
● contextual information; and
● other personalization signals available to the AI Recommendation Engine.
Not every recommendation relies upon every available factor, and the relative importance assigned to individual factors may change as the AI Recommendation Engine evolves. PlateProfile uses information collected through the Services to improve recommendation quality, personalization accuracy, system performance, safety, and overall user experience.
AI-generated recommendations are probabilistic and continuously evolving. Recommendations may change over time as software, statistical models, Bayesian methodologies, machine learning systems, available information, and personalization techniques evolve.
The AI Recommendation Engine is intended solely as an informational decision-support tool and does not constitute medical advice, nutritional counseling, diagnosis, treatment, or any other professional healthcare service. Users should consult qualified healthcare professionals regarding medical, nutritional, allergy-related, or other health decisions.
PlateProfile continually evaluates and improves its artificial intelligence systems to enhance recommendation quality, personalization, safety, reliability, and user experience.
Information processed through the Services may be used to:
● improve recommendation accuracy;
● refine personalization methodologies;
● identify software defects;
● evaluate system performance;
● improve statistical models;
● improve Bayesian methodologies;
● develop machine learning systems;
● conduct product research;
● improve security;
● detect fraud and abuse;
● evaluate feature performance;
● support quality assurance;
● develop future functionality; and
● maintain the Services.
Where reasonably possible, PlateProfile seeks to use aggregated, anonymized, or de-identified information for research, analytics, model evaluation, and product development. PlateProfile does not sell Personal Information for artificial intelligence training. PlateProfile does not knowingly disclose identifiable Consumer Health Data for third-party artificial intelligence training except as necessary to provide the Services, with your authorization where required, or as otherwise permitted or required by applicable law. As artificial intelligence technologies evolve, PlateProfile may update its AI processing practices. Any material changes will be reflected through updates to this Privacy Policy where required by applicable law.
PlateProfile may disclose information to trusted service providers and business partners when reasonably necessary to operate, maintain, improve, secure, or support the Services.
Depending upon the functionality used, information may be shared with providers that perform services including:
● cloud hosting;
● authentication;
● customer support;
● payment processing;
● subscription management;
● analytics;
● crash reporting;
● application monitoring;
● mapping and geolocation;
● grocery information;
● restaurant information;
● artificial intelligence services;
● notification delivery;
● infrastructure management;

● other operational services supporting PlateProfile.
PlateProfile may also disclose information:
● with your direction or consent;
● to comply with applicable law;
● to respond to lawful governmental requests;
● to enforce our Terms of Service;
● to investigate fraud, abuse, or security incidents;
● to protect PlateProfile, our users, or others;
● in connection with mergers, acquisitions, financing transactions, reorganizations, or other business transfers as described later in this Privacy Policy; or
● as otherwise permitted or required by applicable law.
PlateProfile does not sell Personal Information or Consumer Health Data except where expressly disclosed in this Privacy Policy or as otherwise permitted by applicable law. PlateProfile does not receive monetary compensation in exchange for Personal Information except where expressly disclosed and permitted by applicable law. PlateProfile does not disclose Personal Information for cross-context behavioral advertising as defined under applicable California law unless expressly disclosed and accompanied by any notices and choices required by applicable law.
To provide and improve the Services, PlateProfile may integrate with or rely upon independent Third-Party Services. Depending upon the features you use, these providers may assist with:
● cloud hosting;
● authentication and identity verification;
● payment processing;
● subscription management;
● artificial intelligence services;
● restaurant information;
● grocery information;
● mapping and geolocation;
● analytics;
● crash reporting;
● customer support;
● notification delivery;
● infrastructure monitoring;
● security services;
● wearable device integrations; and
● other operational services supporting the Services.
These providers receive only the information reasonably necessary to perform the services they provide on PlateProfile’s behalf. Third-Party Services operate under their own privacy policies and terms. PlateProfile is not responsible for the independent privacy practices of third parties except where required by applicable law.
Whenever reasonably appropriate, PlateProfile seeks to work with service providers that implement appropriate administrative, technical, and organizational safeguards to protect Personal Information.
Depending upon how you access the Services, PlateProfile and certain authorized service providers may use cookies, software development kits (“SDKs”), local storage, application programming interfaces (“APIs”), device identifiers, and similar technologies.
These technologies may be used to:
● authenticate users;
● remember user preferences;
● maintain Account functionality;
● improve application performance;
● understand feature usage;
● perform analytics;
● diagnose software issues;
● detect fraud and abuse;
● improve security;
● personalize user experiences; and
● support future functionality.
Mobile applications generally do not use browser cookies in the same manner as websites but may rely upon SDKs, secure storage, device identifiers, or similar technologies to provide comparable functionality.
Where required by applicable law, PlateProfile will obtain any required consent before using cookies or similar technologies for purposes requiring consent. Users may manage certain permissions through browser settings, device settings, or operating system controls. Disabling certain technologies may affect the availability or functionality of portions of the Services.
Certain features of the Services are available through paid Subscription Services. Subscription purchases made through the Apple App Store, Google Play Store, or other authorized marketplaces are processed by the applicable marketplace or payment provider.
PlateProfile generally does not receive or store complete payment card numbers used for purchases processed through those marketplaces.
PlateProfile may receive limited transaction information necessary to:
● confirm subscription status;
● activate subscription features;
● manage user accounts;
● provide customer support;
● prevent fraud;
● maintain accounting records;
● comply with legal obligations; and
● administer the Services.
Payment processors and application marketplaces maintain their own privacy practices governing payment information collected during transactions.
PlateProfile implements commercially reasonable administrative, technical, and organizational safeguards designed to protect Personal Information from unauthorized access, use, disclosure, alteration, or destruction.
Security measures may include, where appropriate:
● encrypted communications;
● encrypted data storage where appropriate;
● access controls;
● authentication procedures;
● role-based access restrictions;
● infrastructure monitoring;
● security logging;
● vulnerability management;
● software updates;
● fraud detection systems;
● incident response procedures;
● backup protections; and
● other reasonable security safeguards appropriate to the nature of the Services.
Access to Personal Information is limited to personnel, contractors, and service providers who require such access to perform legitimate business functions.
Although PlateProfile works to protect Personal Information using commercially reasonable safeguards, no method of electronic transmission, cloud storage, or information security is completely secure.
Accordingly, PlateProfile cannot guarantee absolute security, and users acknowledge that they provide information at their own risk. Users are responsible for maintaining the confidentiality of their account credentials and for promptly notifying PlateProfile of any suspected unauthorized access to their Account. If PlateProfile becomes aware of a security incident involving Personal Information, we will respond in accordance with applicable law, including providing notification where legally required.
PlateProfile retains Personal Information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, provide the Services, comply with legal obligations, resolve disputes, enforce our Terms of Service, protect users, and operate our business.
Retention periods may vary depending upon:
● the type of information collected;
● the Services used;
● legal or regulatory requirements;
● security needs;
● fraud prevention;
● dispute resolution;
● backup restoration;
● business continuity;
● user requests; and
● other legitimate operational requirements.
When Personal Information is no longer reasonably necessary, PlateProfile will delete, anonymize, de-identify, or otherwise dispose of such information in accordance with applicable law and our internal retention practices.
Aggregated, anonymized, statistical, and de-identified information that cannot reasonably identify an individual may be retained and used for analytics, research, product development, AI improvement, security, and other lawful business purposes to the extent permitted by applicable law.
You may request deletion of your PlateProfile Account at any time through the methods made available within the Services or by contacting PlateProfile. To protect user security, PlateProfile may require reasonable identity verification before processing deletion requests.
Following verification, PlateProfile generally intends to:
● begin processing verified deletion requests promptly;
● remove Personal Information from active production systems within approximately forty-five (45) days; and
● remove or overwrite Personal Information retained solely within backup systems within approximately one hundred eighty (180) days, unless a longer retention period is required or permitted by applicable law. Certain information may be retained for longer periods where reasonably necessary for:
● legal compliance;
● tax obligations;
● accounting;
● fraud prevention;
● abuse prevention;
● security investigations;
● dispute resolution;
● enforcement of our Terms of Service;
● backup restoration;
● protection of PlateProfile or other users; or
● other legitimate business purposes permitted by applicable law.
Deleting your PlateProfile Account does not automatically cancel subscriptions purchased through the Apple App Store, Google Play Store, or another authorized marketplace.
Marketplace subscriptions must be canceled directly through the applicable marketplace. Additional information regarding account deletion and data retention is available in the Terms of Service. Deletion of an Account does not affect any rights or obligations that accrued prior to deletion, including obligations arising under the Terms of Service or applicable law.
PlateProfile believes users should have meaningful control over their Personal Information. Subject to applicable law and the functionality available within the Services, you may:
● access and update your profile information;
● modify dietary preferences;
● update allergies and intolerances;
● change nutrition goals;
● manage Pantry Features and grocery information;
● update restaurant preferences;
● modify certain notification preferences;
● enable or disable location permissions through your device settings;
● request access to certain Personal Information;
● request correction of inaccurate Personal Information;
● request deletion of your Account and Personal Information;
● manage Subscription Services through the applicable marketplace; and
● contact PlateProfile regarding questions about your privacy.
Some information may remain subject to legal retention requirements or other exceptions described in this Privacy Policy and our Terms of Service. Exercising your privacy rights will not result in unlawful discrimination or retaliation. However, certain requests may affect the availability or functionality of portions of the Services where the requested information is necessary to provide those Services.
If you are a California resident, you may have certain rights under the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), and other applicable California privacy laws.
Subject to applicable law, you may have the right to:
● know the categories of Personal Information we collect;
● know the categories of sources from which Personal Information is collected;
● know the business or commercial purposes for collecting, using, disclosing, or processing Personal Information;
● know the categories of third parties with whom Personal Information is shared or disclosed;
● request access to the Personal Information we maintain about you;
● request correction of inaccurate Personal Information;
● request deletion of Personal Information, subject to applicable legal exceptions;
● obtain a portable copy of certain Personal Information;
● limit the use or disclosure of Sensitive Personal Information where required by law; and
● exercise your privacy rights without unlawful discrimination or retaliation.
PlateProfile will respond to verified requests within the time periods required by applicable law. PlateProfile does not sell Personal Information or share Personal Information for cross-context behavioral advertising as those terms are defined under California law unless expressly disclosed in this Privacy Policy and accompanied by any notices and choices required by applicable law.
California residents may submit privacy requests using the contact methods described at the end of this Privacy Policy. Nothing in this Section limits any additional rights available under California law.
DATA RIGHTS
If you are a Washington resident, certain information collected through the Services—including dietary preferences, allergies, intolerances, nutrition goals, food selections, ingredient preferences, health-related meal history, and similar information—may constitute Consumer Health Data under the Washington My Health My Data Act (“MHMDA”) or other applicable law. Where applicable, you may have the right to:
● confirm whether Consumer Health Data is collected;
● access Consumer Health Data maintained by PlateProfile;
● request deletion of Consumer Health Data;
● withdraw consent where processing is based upon consent;
● appeal certain decisions where required by applicable law; and
● exercise any additional rights granted under Washington law.
PlateProfile processes Consumer Health Data only for purposes described in this Privacy Policy, including:
● providing personalized recommendations;
● operating and improving the Services;
● maintaining Account functionality;
● improving the AI Recommendation Engine;
● protecting users and the Services;
● detecting fraud and abuse;
● complying with legal obligations; and
● other lawful purposes described in this Privacy Policy.

The Services are not directed to children under thirteen (13) years of age or any higher minimum age required by applicable law. PlateProfile does not knowingly collect Personal Information from children who are prohibited from using the Services without legally required authorization.
If PlateProfile becomes aware that Personal Information has been collected from a child in violation of applicable law, we will take reasonable steps to investigate and, where appropriate, delete such information as soon as reasonably practicable.
Parents or legal guardians who believe that a child has provided Personal Information through the Services may contact PlateProfile using the contact information provided in this Privacy Policy. Nothing in this Section limits any additional protections provided to children under applicable law.
PlateProfile is based in the United States, and the Services are intended primarily for users located in jurisdictions where the Services are made available. If you access the Services from outside the United States, you acknowledge that your Personal Information may be transferred to, stored in, and processed within the United States or other jurisdictions where PlateProfile or its service providers operate.
Data protection laws in those jurisdictions may differ from the laws of your country of residence. By using the Services, you acknowledge and, where required by applicable law, consent to such transfers, processing, and storage. PlateProfile will implement appropriate safeguards where required by applicable law for international transfers of Personal Information.
As PlateProfile grows, our business may evolve through financing transactions, investments, mergers, acquisitions, reorganizations, asset sales, or other corporate transactions. In connection with such transactions, Personal Information may be disclosed to prospective investors, lenders, purchasers, advisors, auditors, legal counsel, or other parties involved in evaluating or completing the transaction, subject to appropriate confidentiality obligations and applicable law.
If ownership or control of PlateProfile or substantially all of its assets changes, Personal Information may be transferred as part of that transaction, subject to applicable law and the commitments made in this Privacy Policy. If a transaction results in material changes to how your Personal Information is handled, PlateProfile will provide any notices required by applicable law before those changes become effective.
PlateProfile may update, modify, revise, supplement, or replace this Privacy Policy from time to time to reflect:

● technological developments;
● new products or features;
● changes to Subscription Services;

The Effective Date appearing at the beginning of this Privacy Policy indicates the date on which the most recent revision became effective. Except where applicable law requires additional consent, your continued access to or use of the Services after an updated Privacy Policy becomes effective constitutes your acceptance of the revised Privacy Policy.
If you do not agree with the revised Privacy Policy, you should discontinue use of the Services and, where applicable, request deletion of your Account.

This Privacy Policy replaces all prior versions of the PlateProfile Privacy Policy and remains effective until amended or replaced by a subsequent version. If any provision of this Privacy Policy is determined to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
Nothing in this Privacy Policy limits any rights or obligations provided under PlateProfile’s Terms of Service or applicable law. This Privacy Policy should be interpreted in a manner that is consistent with the PlateProfile Terms of Service whenever reasonably possible.
