Terms of Service | Version 2.0 | Prepared October 9, 2026
PlateProfile Labs LLC | Venice, Florida, USA
Effective upon publication by PlateProfile, subject to the notice and acceptance provisions in Section 34.
1. Agreement and scope
These Terms of Service (Terms) govern your use of the PlateProfile mobile application, website, recommendation
features, subscriptions, and related services offered by PlateProfile Labs LLC (PlateProfile, we, us, or our), based in
Venice, Florida, USA. Together these are the Services. By affirmatively accepting these Terms, or using the Services
after being given clear notice that use constitutes acceptance, you agree to these Terms to the extent permitted by
law. If you do not agree, do not use the Services.
Our Privacy Notice explains how we handle personal information. Accepting these Terms is not a substitute for a
separate privacy consent that applicable law or an app marketplace requires. Mandatory consumer rights remain
available regardless of these Terms.
2. Key definitions
Account means your registered PlateProfile account. AI Output means an automated or AI-assisted meal
suggestion, ranking, explanation, recipe, ingredient substitution, restaurant suggestion, or nutrition estimate.
Recommendation Engine means the combination of filtering, scoring, statistical learning, and other software used
to personalize recommendations; specific methods can vary by feature and software version.
User Content means material you submit, such as profile information, dietary preferences, allergies, feedback,
meal history, and uploaded images. Third-Party Services means independent providers, apps, databases,
restaurants, stores, and other external services. Personal information and consumer health data have the
meanings given in the Privacy Notice and applicable law.
3. Eligibility and minors
PlateProfile is a general-audience meal-recommendation service and is not designed or directed for children
under 13. Children under 13 should not create an account or submit personal or dietary information. This is a
statement of intended use, not a claim that PlateProfile verifies every user’s age. If you are under the age of
majority where you live, involve a parent or legal guardian in decisions about your diet and use of the Services.
Where the law requires an adult’s agreement to contract, the parent or guardian must provide it.
You must have legal authority to accept these Terms or the involvement of a parent or guardian required by
applicable law. Provide accurate account information and comply with applicable law. Parental supervision,
acceptance of these Terms, or an app-store age rating does not substitute for any legally required verifiable
parental consent for a child’s personal information. If we learn that an account involves a child under 13, we may
restrict processing or access while we take the steps the law requires.
4. What PlateProfile provides
PlateProfile helps answer, “What should I eat now?” Available features may include Eat at Home, Eat Out
(Restaurant Mode), meal suggestions, dietary preferences, meal timing, recipe or nutrition information, feedback,
saved meals, and subscriptions. Feature availability depends on your app version, location, and plan. Descriptions of other features apply only if those features are made available to you; nothing in these Terms promises a future
release.
Features, usage limits, and plan benefits are described in the app and at purchase. We may update the Services for
functionality, security, or legal reasons. For a material reduction in a paid service, we will provide notice and any
cancellation, refund, or other remedy required by law, marketplace rules, or the offer you purchased. Beta
features may be incomplete and may change or end.
5. Personalization and AI limitations
PlateProfile may use the preferences, allergies, dislikes, goals, meal timing, saved meals, accepts, swaps, skips,
ratings, and other interactions relevant to the features you use. Its personalized recommendation technology may
combine dietary filtering, statistical preference learning, local scoring, and AI-assisted processing; methods can
differ by feature and software version. Dietary and allergy restrictions are intended to be considered before
preference ranking, but incomplete source data, hidden ingredients, cross-contact, or software errors can make a
recommendation unsuitable. Inferred preferences are estimates, not medical conclusions.
AI Output can be incorrect, incomplete, inconsistent, or outdated. Explanations and suitability labels are
informational and do not certify safety. A missing warning does not establish that a food is safe. Updating your
profile helps personalization but cannot eliminate incomplete source data or errors. There is no guarantee of a
particular meal match, nutritional result, weight change, or health outcome.
Learning your preferences to provide your requested service is distinct from using information to train a general
purpose AI model. Personal-information use, provider disclosures, and any optional training are limited by the
Privacy Notice and required consents; these Terms do not grant unrestricted training rights.
6. Medical, nutrition, and food safety notice
PlateProfile provides informational meal-selection assistance. It is not a healthcare provider or a substitute for
individualized medical or dietetic advice. The Services are not intended to diagnose, treat, cure, prevent, monitor,
or manage disease. No professional healthcare relationship is created. Consult a qualified professional about a
medically prescribed diet, medication-related dietary restrictions, pregnancy, an eating disorder, or other medical
needs.
Always verify ingredients, portions, allergen statements, cross-contact risks, storage, preparation, and cooking
instructions using reliable sources and the relevant restaurant or manufacturer. Nutrition values are estimates
and may differ by serving size, brand, preparation, or substitutions. For a serious allergy, do not rely on an app
recommendation or menu scan to decide whether food is safe.
PlateProfile does not monitor emergencies. For an allergic reaction or other emergency, contact emergency
services immediately and follow your prescribed emergency plan. These warnings do not exclude any duty or
liability that cannot lawfully be excluded.
7. Eat Out, location, and restaurant information
Restaurant information, menu items, prices, opening hours, nutrition information, travel estimates, and
availability may be inaccurate or change without notice. Confirm important information directly with the
restaurant. A listing is not evidence of a partnership or certification. Unless an order or booking feature expressly
states otherwise, a recommendation does not place an order or reservation.
Location-enabled features use location as explained in the Privacy Notice and permission request. You can change
device permissions. Estimated distance or travel time is not guaranteed. Use location features safely and do not
operate the app while driving.
Where menu-photo upload or menu-analysis is made available, image recognition and automated classification
can misread, omit, translate incorrectly, or infer details not present in the source. A scanned menu does not
establish the presence or absence of every ingredient or a restaurant’s cross-contact procedures. Review the
original menu and confirm food safety directly with the restaurant.
If image uploads are offered, submit only material you have permission to use. Avoid images with faces, payment
information, identification documents, or unrelated private details. Image processing and relevant providers are
described in the Privacy Notice. Uploading a menu does not transfer ownership of third-party content or authorize
its public republication
8. Accounts and security
Keep registration and dietary information reasonably current, safeguard your sign-in credentials, and notify
support@plateprofile.com of suspected unauthorized access. You are responsible for activity you authorize and for
reasonable care of your account; this does not shift to you responsibility for our security failures or for activity for
which law does not make you responsible.
We may use proportionate identity verification for account recovery, privacy requests, or sensitive changes. Do
not share passwords, authentication codes, or payment credentials with support. We may suspend suspicious
access while investigating and will provide appropriate recovery assistance.
9. Acceptable use and security reports
Do not misuse the Services, break the law, infringe another person’s rights, impersonate others, submit malicious
code, attempt unauthorized access, disrupt service, manipulate subscriptions, or collect other users’ information.
Do not scrape or systematically extract protected content, circumvent access controls, or use the Services to
develop a competing product in violation of our rights. Restrictions on reverse engineering apply only to the
extent permitted by law.
Security testing requires our written permission or authorization expressly provided by a vulnerability disclosure
policy we publish. Report suspected vulnerabilities to support@plateprofile.com without accessing, altering, or
exposing other users’ data. Nothing here restricts legally protected research, whistleblowing, regulator
communications, honest reviews, or other rights that cannot be waived.
10. Subscriptions, trials, and cancellation
PlateProfile offers eligible subscribers a fourteen (14)-day free trial of PlateProfile Plus. During the free trial,
eligible subscribers may use the Plus features made available with the offer without a Plus subscription charge.
When an eligible user enrolls in an automatically renewing Plus subscription trial through Apple or Google Play,
the subscription converts to a paid Plus subscription when the 14-day trial ends unless it is canceled before the
applicable marketplace deadline. At that time, the marketplace charges the price for the chosen monthly or annual
plan, and the subscription renews according to the billing period disclosed and accepted at checkout unless
canceled. The app and marketplace checkout display the applicable price, currency, renewal frequency, included
features, trial end, cancellation details, and eligibility conditions before authorization. Your accepted checkout
offer controls transaction-specific details, and free-trial eligibility may be limited by previous subscriptions,
platform rules, region, or other disclosed conditions.
To manage or cancel your subscription, follow the Manage Subscription link in the app’s account or subscription
settings where available, or use the platform that billed you: Apple Account > Subscriptions for Apple purchases,
or Google Play > Payments & subscriptions > Subscriptions for Google Play purchases. You can also contact
support@plateprofile.com for navigation assistance. Cancellation ordinarily stops future renewals, not an already
incurred charge; access usually continues until the end of the current paid period, subject to applicable marketplace rules and consumer rights. You may cancel during the 14-day Plus trial through the billing
marketplace to avoid the first subscription charge. The marketplace determines whether trial access ends
immediately or continues to the trial expiration date; review the applicable cancellation confirmation.
Uninstalling PlateProfile, deactivating your account, or deleting your account does not by itself cancel a
marketplace subscription. Cancel through the marketplace to avoid future charges. We will make this distinction
clear in the deletion process; cancellation is not a condition of exercising a legally protected deletion right.
Request refunds through the marketplace that billed you, or contact support for assistance. Statutory refund rights
and marketplace remedies are preserved. Price increases and material subscription changes apply prospectively
with required notice and consent. We will not retroactively increase a charge already incurred or deny a remedy
required by law.
11. Privacy and required permissions
We process personal information under the Privacy Notice and our separate Consumer Health Data Privacy Notice
where applicable. We request device permissions and separate consent when required. Agreement to these Terms
does not waive privacy rights or authorize disclosures, advertising, model training, or data sales beyond those
permitted by those notices and the law.
Your choices may limit a feature that needs the relevant information. We remain responsible for obligations
imposed on us when using service providers; a provider disclaimer does not remove those obligations.
12. User Content and limited license
You retain whatever rights you have in User Content. You grant us a nonexclusive, royalty-free license to host,
reproduce, process, adapt as technically necessary, and display that content only to operate and secure the
Services, provide your requested features, and perform other processing allowed by the Privacy Notice and your
valid choices. We may permit contracted providers to do the same only for those purposes. Transfer of this license
is limited to a lawful transfer of the relevant business subject to the same restrictions.
This license does not authorize selling your personal information, publishing private profile or health information,
or unrestricted third-party AI training. It ends when the content is deleted, except for limited lawful retention
described in the Privacy Notice. Retained content may be used only for the permitted retention purpose. You must
have the rights needed to submit content; we may remove unlawful or abusive material.
13. Feedback
You may voluntarily provide product ideas or suggestions. You permit us to use those ideas without compensation
or an obligation to implement them. This permission does not transfer your ownership of other User Content,
override privacy protections, or allow us to publish your private correspondence or identity as an endorsement
without permission.
14. Account deletion and retention
You may request permanent account deletion using the in-app account-deletion flow or by contacting
support@plateprofile.com. A request can be made from outside the app without reinstalling it; PlateProfile will
provide a discoverable web-based request route for Google Play users as required by that platform. Temporary
deactivation, if offered, is not deletion. Permanent deletion may remove saved meals, preferences, and access to
account features; retrieve any information you wish to keep first.
We promptly verify and process requests within the deadlines described in the Privacy Notice and applicable law.
The Privacy Notice governs timing, limited retention exceptions, backup removal, and notification to relevant processors. You may also request deletion of particular personal information without deleting the entire account,
subject to applicable law and the information needed for your requested features. A verification step does not
extend a statutory deadline where the law prohibits that. We do not retain personal information indefinitely
merely because it might be useful for future AI development.
Account deletion and subscription cancellation are separate actions as explained in Section 10. A lawful retention
obligation does not justify keeping unrelated information or continuing ordinary personalization after deletion.
15. Intellectual property and permitted use
PlateProfile and its licensors retain their rights in the software, branding, original content, interfaces, and
underlying recommendation technology. Subject to these Terms and applicable marketplace license terms, you
receive a limited, nonexclusive, nontransferable license to access and use the Services for personal,
noncommercial purposes. You may use recommendations for ordinary personal meal planning and cooking.
No ownership in our underlying models, software, trade secrets, or licensed databases transfers to you. Third
party rights remain with their owners. We do not claim exclusive copyright in facts, public-domain material, or
material that cannot legally be owned. AI Output may resemble output provided to others and may be subject to
third-party rights.
16. Third-party services and marketplaces
Independent restaurants, stores, mapping services, and linked websites control their own services. Their separate
terms may govern your direct interactions with them. Availability and accuracy can change. We are not the seller
or preparer of a meal merely because it appears in the app.
These provisions do not disclaim our responsibility for our own conduct or legal duties concerning providers
processing data on our behalf. Marketplace billing and licensing terms apply where relevant. For an Apple
download, the Apple Standard Licensed Application End User License Agreement applies unless a valid custom
agreement has been supplied through the App Store. These Terms supplement, and do not displace, mandatory
marketplace terms.
17. Disclaimers and consumer protections
To the maximum extent permitted by law, the Services and AI Output are provided on an “as is” and “as available”
basis. We do not warrant uninterrupted operation, perfect accuracy, or fitness for a particular medical or dietary
need. To that extent, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non
infringement.
Nothing excludes a nonwaivable warranty, express commitment required to be honored, statutory consumer
guarantee, or remedy for misleading statements or unlawful conduct. If your jurisdiction does not permit a
disclaimer, it does not apply to you to that extent.
18. Limitation of liability
To the extent permitted by law, PlateProfile and its personnel and licensors are not liable for indirect, incidental,
special, or consequential losses arising from the Services, such as lost profits or business interruption. Subject to
the exclusions below, PlateProfile’s total liability for claims arising from the Services is limited to the greater of US
$100 or the amounts you paid for PlateProfile Services, including through an app marketplace, during the 12
months before the event giving rise to the claim.
These limitations do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by
negligence where exclusion is prohibited, or any liability, statutory remedy, or consumer right that cannot lawfully be limited. They do not relieve us of mandatory data-protection or security obligations. The limitations
apply only as far as the law permits in the circumstances of the claim.
19. Responsibility for third-party claims
To the extent permitted by law, you agree to reimburse PlateProfile for reasonable losses and legal costs resulting
from a third-party claim caused by your unlawful conduct, intentional misuse of the Services, or submission of
content you knowingly lacked rights to provide. This does not apply to ordinary authorized use, our own fault, or
liability that cannot be shifted to you.
We will give prompt notice of a covered claim and a reasonable opportunity to participate in its defense. We will
not agree to a settlement requiring your admission of wrongdoing or a nonmonetary obligation without your
consent, not to be unreasonably withheld. You may not settle a claim on our behalf without our consent.
20. Suspension and service termination
We may restrict access for a material breach, fraud, security risk, legal requirement, or discontinuation of the
Services. Where reasonably practicable, we will give notice, explain the reason, and provide an opportunity to
address the issue. Immediate action may be necessary to protect users or comply with law. Contact support to
dispute a restriction.
If we discontinue a paid service or end access for reasons unrelated to your breach, we will honor applicable
refund and cancellation obligations and assist with marketplace remedies. Termination does not remove privacy
rights or lawful claims. Provisions intended to survive, including accrued payment obligations, intellectual
property, valid liability limits, and dispute provisions, survive only as applicable.
21. California and other state rights
Where applicable, state privacy laws provide rights concerning access, correction, deletion, portability, consent,
and certain processing choices. The Privacy Notice explains how to exercise them. You may contact regulators and
exercise nonwaivable consumer remedies; these Terms do not require you to waive those rights.
22. Consumer health data
Allergies, dietary restrictions, meal history, and related inferences can be consumer health data. Applicable
protections may extend beyond Washington residents, including individuals whose consumer health data is
collected in Washington. The Privacy Notice and applicable separate consumer health data notice explain the
relevant processing and choices. General acceptance of these Terms is not health-data consent.
23. Children’s privacy
As explained in Section 3, PlateProfile is not directed to children under 13. If you are a parent or guardian who
believes a child under 13 has provided personal information, contact support@plateprofile.com. When we obtain
actual knowledge of such collection, we will limit further processing and either obtain any required verifiable
parental consent or delete the information, as applicable. We do not rely on these Terms as blanket parental
consent or represent that an in-app age-verification control is in place.
24. Accessibility
Contact support@plateprofile.com to report an accessibility barrier or request assistance accessing these Terms or
the Services. We will consider reasonable accommodations and improvements and comply with applicable accessibility obligations. To help us respond, describe the affected feature and the assistance you need; do not
include unnecessary sensitive information.
25. Export and sanctions compliance
You must not use or transfer the Services in violation of applicable export controls or sanctions. We may restrict
access when legally necessary. This provision applies only to restrictions actually applicable to the transaction or
use.
26. Electronic notices and marketing choices
We may send account, billing, security, service, and legal notices electronically using the app or your account
email. Maintain current contact information. Where legally required, we will obtain separate consent for
electronic records or use another legally permitted delivery method.
You can opt out of promotional email using its unsubscribe link and manage push permissions in device settings.
Optional marketing consent is separate from agreeing to these Terms. Essential account or legal messages may still
be sent. Declining marketing does not prevent use of unrelated features.
27. Copyright and intellectual property complaints
Send complaints to support@plateprofile.com with identification of the protected work and disputed material, its
location in the Services, your contact details, a good-faith statement, a statement of accuracy and authority under
penalty of perjury where applicable, and your signature. We will assess and respond under applicable law, which
may include removal and a counter-notice process.
We may terminate repeat infringers in appropriate circumstances. Where a statutory notice or counter-notice
procedure applies, we will follow its requirements. This complaint process does not restrict your legal remedies or
require you to waive rights in your work.
28. Informal dispute resolution
Please contact support@plateprofile.com with a description of a dispute and your requested resolution. Both
parties will try in good faith to resolve it for 30 days before litigation when practicable. This process does not
prevent urgent relief, a small-claims filing, a regulator complaint, or timely action needed to preserve a legal right.
It does not shorten or silently extend a statutory filing deadline. These Terms do not impose mandatory arbitration
or a class-action waiver.
29. Governing law and venue
Florida law governs these Terms, excluding conflict-of-law rules, except that mandatory protections of the law
applicable to you remain effective. Subject to those protections and a court’s jurisdiction, disputes may be brought
in Florida state courts in Sarasota County or the United States District Court for the Middle District of Florida. To
the extent lawful, those courts are the exclusive venue, without restricting an available small-claims forum or a
forum required by consumer law.
30. Events outside reasonable control
Neither party is responsible for delay caused by an event beyond its reasonable control to the extent the law
permits, provided reasonable efforts are made to limit disruption. This does not excuse accrued obligations,
reasonable security duties, or refunds and other consumer remedies required by law.
31. Assignment
You may not transfer this agreement without our consent except as permitted by law. We may transfer it with the
relevant business in a lawful merger, reorganization, or sale if your contractual and privacy protections continue
and required notices are given. A transfer does not authorize new data uses or remove mandatory rights.
32. Severability and waiver
If a provision is unenforceable, the remaining provisions continue to the extent lawful. An invalid provision may
be limited only as the law permits. Failure to enforce a provision once is not a waiver of future enforcement. No
waiver removes a nonwaivable legal right.
33. Entire agreement and policy priority
These Terms and the purchase terms presented to you form the agreement for the Services, together with any
feature-specific terms expressly brought to your attention and accepted where required. The Privacy Notice
governs personal-information processing; applicable health-data notices and more protective mandatory law
govern their subject matter. A general User Content license cannot override them.
Supplemental safety, security, and other policies explain relevant practices. They do not silently expand
permissions, add new charges, or remove remedies. No older supplemental policy permits a practice expressly
prohibited by the current Privacy Notice. Mandatory law and marketplace rules prevail where applicable.
34. Changes and effective date
We will publish an effective date and version when revised Terms are adopted and give reasonable advance notice
of material changes, except where an urgent legal or security need justifies a shorter period. We will obtain
affirmative acceptance when required. Changes operate prospectively and do not retroactively remove accrued
rights. Continued use constitutes acceptance only where lawful and after adequate notice.
If you disagree with a change, stop using the Services and cancel future subscription renewals as appropriate,
without losing rights already accrued. Version 2.0 was prepared on October 9, 2026. It becomes effective when
PlateProfile publishes it for use, subject to any later date stated in the notice to existing users and any required
acceptance. Preparing or privately circulating this document does not change the Terms already applicable to an
account.
