1. INTRODUCTION

This Washington Consumer Health Data Notice (“Notice”) explains how PlateProfile Labs LLC (“PlateProfile,” “Company,” “we,” “our,” or “us”) collects, uses, discloses, protects, retains, and otherwise processes Consumer Health Data as defined under the Washington My Health My Data Act (“MHMDA”) and other applicable law.

This Notice applies only to Consumer Health Data that is subject to the MHMDA or other applicable consumer health data laws.

This Notice supplements, and should be read together with, the PlateProfile Privacy Policy and Terms of Service. In the event of any conflict regarding Consumer Health Data, this Notice governs to the extent required by applicable law.

2. SCOPE

This Notice applies to Washington residents and any other individuals whose Consumer Health Data is protected by applicable law.

This Notice applies whenever you:

  • create a PlateProfile Account;
  • use the PlateProfile mobile application;
  • use Restaurant Mode;
  • use Pantry Features;
  • receive meal recommendations;
  • receive grocery recommendations;
  • interact with the AI Recommendation Engine;
  • contact customer support; or
  • otherwise use PlateProfile Services.

3. CONSUMER HEALTH DATA WE COLLECT

Depending on how you use the Services, PlateProfile may collect Consumer Health Data including:

  • dietary preferences;
  • food allergies;
  • food intolerances;
  • dietary restrictions;
  • nutrition goals;
  • meal selections;
  • meal history;
  • accepted recommendations;
  • rejected recommendations;
  • ingredient preferences;
  • ingredient substitutions;
  • favorite foods;
  • food dislikes;
  • pantry information;
  • grocery information;
  • restaurant selections;
  • health-related profile information voluntarily provided by you; and
  • any other information that constitutes Consumer Health Data under applicable law.

The exact information collected depends upon the features you use and the information you choose to provide.

4. SOURCES OF CONSUMER HEALTH DATA

PlateProfile may collect Consumer Health Data from:

  • information you voluntarily provide;
  • information generated while using the Services;
  • your interactions with recommendations;
  • meal selections;
  • ingredient substitutions;
  • Pantry Features;
  • grocery functionality;
  • Restaurant Mode;
  • customer support communications;
  • device permissions that you authorize, including precise location where applicable; and
  • other information generated through your use of the Services.

5. PURPOSES FOR COLLECTION

PlateProfile collects Consumer Health Data only for legitimate business purposes, including:

  • generating personalized meal recommendations;
  • generating restaurant recommendations;
  • generating grocery recommendations;
  • maintaining Pantry Features;
  • personalizing future recommendations;
  • improving recommendation quality;
  • improving the AI Recommendation Engine;
  • maintaining your Account;
  • providing Subscription Services;
  • responding to customer support requests;
  • preventing fraud and abuse;
  • protecting users and the Services;
  • improving security;
  • complying with legal obligations; and
  • other lawful purposes described in our Privacy Policy.

PlateProfile collects only the Consumer Health Data reasonably necessary to provide and improve the Services.

6. DISCLOSURE OF CONSUMER HEALTH DATA

PlateProfile may disclose Consumer Health Data to trusted service providers only when reasonably necessary to operate the Services.

Depending on the functionality used, disclosures may include providers performing:

  • cloud hosting;
  • authentication;
  • customer support;
  • payment processing;
  • subscription management;
  • artificial intelligence services;
  • analytics;
  • infrastructure management;
  • mapping and geolocation;
  • restaurant information;
  • grocery information;
  • fraud prevention;
  • security services; and
  • other operational services supporting PlateProfile.

PlateProfile does not sell Consumer Health Data except where expressly permitted by applicable law and disclosed to users.

PlateProfile does not disclose Consumer Health Data for third-party advertising except where permitted by applicable law.

7. HOW WE PROTECT CONSUMER HEALTH DATA

PlateProfile implements commercially reasonable administrative, technical, and organizational safeguards designed to protect Consumer Health Data.

Safeguards may include:

  • encrypted communications;
  • access controls;
  • authentication procedures;
  • infrastructure monitoring;
  • security logging;
  • fraud detection;
  • role-based access restrictions;
  • software updates;
  • incident response procedures; and
  • other reasonable security measures appropriate to the Services.

Although PlateProfile works to protect Consumer Health Data, no security system is completely secure.

8. RETENTION OF CONSUMER HEALTH DATA

PlateProfile retains Consumer Health Data only for as long as reasonably necessary to:

  • provide the Services;
  • personalize recommendations;
  • maintain user Accounts;
  • comply with legal obligations;
  • resolve disputes;
  • protect users;
  • enforce our Terms of Service;
  • improve the AI Recommendation Engine; and
  • operate our business.

When Consumer Health Data is no longer reasonably necessary, PlateProfile will delete, anonymize, de-identify, or otherwise dispose of the information in accordance with applicable law.

9. YOUR RIGHTS

Subject to applicable law, you may have the right to:

  • confirm whether PlateProfile collects Consumer Health Data;
  • access Consumer Health Data maintained by PlateProfile;
  • request deletion of Consumer Health Data;
  • withdraw consent where processing is based upon consent;
  • appeal certain decisions where required by applicable law; and
  • exercise any additional rights available under Washington law.

Certain requests may require identity verification before processing.

Certain information may be retained where required or permitted by applicable law.

10. EXERCISING YOUR RIGHTS

You may submit Consumer Health Data requests by contacting PlateProfile using the information provided below.

To protect user privacy and security, PlateProfile may require reasonable verification of identity before processing requests.

PlateProfile will respond to verified requests within the time periods required by applicable law.

11. CHANGES TO THIS NOTICE

PlateProfile may revise this Notice from time to time to reflect:

  • changes in applicable law;
  • regulatory guidance;
  • technological developments;
  • changes to the Services;
  • operational improvements; or
  • other legitimate business needs.

When required by applicable law, PlateProfile will provide appropriate notice before material changes become effective.

The Effective Date at the beginning of this Notice indicates the most recent revision.

This Washington Consumer Health Data Notice supplements the PlateProfile Privacy Policy and Terms of Service and remains effective until amended or replaced by a subsequent version.

If any provision of this Notice is determined to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
